...であるのに in spite of the fact that ... の形で文を続けることもできますが、少し長くかたい表現です。

使い方

後ろは名詞か動名詞

in spite of the rain, in spite of being tired のように使います。普通は in spite of he was tired とは言いません。
despite とほぼ同じ

in spite of と despite はほぼ同じ意味です。despite は of を付けずに使います。

よくある間違い

誤: In spite of he was sick, he came.

正: In spite of being sick, he came.

despite には of を付けません。of を使うなら in spite of です。
